Kast Virtual Staging, AI Virtual Staging for Real Estate

1. Acceptance of Terms

By accessing or using Kast Virtual Staging ("the Service"), operated by Kast Staging, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

Kast Virtual Staging provides AI-powered image transformation tools for real estate professionals, currently virtual staging and photo decluttering. Access to the Service is purchased through one-time credit packs.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when registering. You may not share your account with others.

4. Credit Packs and Payments

Access to image generation features requires a credit balance. Credits are purchased in one-time packs and are not part of a subscription. A pack entitles you to stage the number of photos stated at checkout, and staging a photo includes every version you generate from it. Unused credits expire twelve months from the date of purchase and are used oldest first. Purchases are non-refundable except in cases of technical error on our part. All prices are in CAD.

5. Acceptable Use

You may use the Service only for lawful purposes. You may not: upload content that violates intellectual property rights; use the Service for deceptive or fraudulent purposes; attempt to reverse-engineer or extract our AI models; resell or redistribute outputs without attribution; or use the Service in any way that could damage our systems.

6. Intellectual Property

You retain ownership of images you upload. You grant us a limited license to process your images solely to provide the Service. All AI-generated outputs are yours to use commercially. Kast Staging retains ownership of the underlying technology, models and platform.

7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated results will meet any particular quality standard. Use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Kast Staging shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles. For users in the United States, these Terms are also subject to applicable US federal laws.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
